Terms of service

1. Acceptance
By using CleanCalc CA (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is, and isn't
The Service is an informational calculator that estimates California child support based on Cal. Family Code §4055 and inputs you provide. It is not legal advice, does not create an attorney–client relationship, and does not constitute the practice of law. The Service does not exercise professional judgment about your specific facts.
The Service applies Cal. Family Code §§4055 et seq. and the accuracy + disclosure standards of Cal. Rule of Court 5.275. The Service is not a Judicial Council–certified calculator under Cal. Fam. Code §3830 and is not a substitute for one. When you file Form FL-342, Item 1 of that form authorizes "a printout of a computer calculation and findings is attached and incorporated in this order"; the Service's worksheet PDF is designed for that role, not for use as a substitute for the FL-342 order form itself. The court applies the §4055 guideline as a rebuttable presumption under §4057 and may deviate based on the facts.
3. Spousal support — temporary vs. permanent
Spousal-support estimates produced by the Service use the Santa Clara County guideline formula (or Alameda or Marin if you select an alternate county), which California courts informally use to estimate temporary spousal support during pending dissolution proceedings under Cal. Fam. Code §3600. The Service does not compute permanent (post-judgment) spousal support. Permanent spousal support is governed by Cal. Fam. Code §4320, which enumerates fourteen discretionary factors that the court weighs case by case. In re Marriage of Schulze (1997) 60 Cal.App.4th 519 holds that using a guideline formula for permanent spousal support is reversible error. The Service displays the §4320 factors as a checklist only, not as a computation.
4. AS IS; no warranty
The Service is provided "AS IS" and "as available," without warranty of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, current with the latest statutory amendments, or suitable for any specific use.
5. Limitation of liability
To the maximum extent permitted by law, our total liability arising from or related to your use of the Service is limited to USD $10 or the fees you paid for the Service in the 12 months preceding the claim, whichever is greater. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost income, lost custody, attorneys' fees, or court outcomes, even if we have been advised of the possibility of such damages.
6. Your responsibilities
You are responsible for verifying any number produced by the Service against authoritative sources (a Judicial Council–certified calculator, a licensed California family-law attorney, your court's self-help facilitator) before relying on it for any legal, financial, or strategic decision.
7. Acceptable use
You agree not to use the Service to (a) violate any law, (b) misrepresent the Service or its output as a Judicial Council–certified calculation under Cal. Fam. Code §3830, (c) attempt to reverse-engineer or scrape the Service in ways that interfere with other users, or (d) use the Service in a manner that creates a risk of harm to others.
8. Intellectual property
All content, code, and design of the Service is the property of the Service operator unless otherwise noted. You receive a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial estimation purposes.
9. Termination
We may suspend or terminate access to the Service at any time, with or without notice, for any reason. The provisions of Sections 3, 4, 5, 8, 10, and 11 survive any termination.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in California.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged at the top of this page for at least 30 days. Continued use of the Service after a change constitutes acceptance of the revised Terms.
